LICENSE OF USE OF THE DIGITAL FORMAT REPORTS

PLEASE READ CAREFULLY THIS LICENSE BEFORE USING AND EACH TIME YOU USE OR RECORD ANY OF THE DIGITAL FORMAT REPORTS AVAILABLE ON THE WEBSITE OF KONDIA. TO ACCESS, EXPORT OR IMPORT THESE REPORTS YOU MUST NECESSARILY ACCEPT THE TERMS ESTABLISHED IN THIS LICENSE OF USE

1. The customer (beneficiary) states that he/she agrees with all the terms and conditions established in this License of use of the digital format REPORTS marketed and supplied on the website of KONDIA (hereinafter the REPORTS). These terms and conditions can be subject to change without a previous notification as KONDIA decides so.
     
2. The exploitation rights of the REPORTS belong exclusively to KONDIA, who, by means of this contract, gives License of use to the beneficiary according to the following stipulations.
     
3. KONDIA has and will have any time the full right of ownership and property of the REPORTS and assures to be entitled to give License of use by means of this present contract.
     
   The beneficiary is not allowed to lend, donate, cede, assign, sale or rent this License of use to third party. Any attempt to concede, transfer, let, sale, rent or give a copy of any of the rights and obligations hereby established to a third party will cause the invalidity of this License contract and the contractual good faith of the beneficiary will be considered as dishonest.
     
   The beneficiary is obliged and commits him/herself to take any necessary measure to prevent unauthorized third parties from getting knowledge and information about the documents of KONDIA.
   The beneficiary must keep all indications about the property (marks, copyright symbols, etc.) contained in the documnets of KONDIA in a good state, as they specify the ownership of rights in favour of KONDIA.
     
   The beneficiary must keep the symbols, marks or any other property indication established by KONDIA in the product, in any total or partial reproduction specifically authorized by KONDIA by virtue of this contract.
     
   The beneficiary will inform KONDIA of any act of unfair competition or any violation of the patent or intelectual rights he/she might have knowledge of, and in general, he/she will take all necessary measures to assure the confidentiality and respect to the property right corresponding to KONDIA.
     
4. The License of use of the REPORTS is given strictly for one specific user and one specific post. The beneficiary is not allowed to use them within a computer net, simultaneous access system, multiple central process unit or multi-user system, unless a written agreement is specially established with KONDIA for this purpose.
     
   In case of defective operation of your computer preventing you from access and using the REPORTS, you are allowed to transfer them to another computer, provided that they are removed from the computer they are transferred from and the use of the REPORTS in the new computer is subject to terms established by this agreement.
     
5. KONDIA allows the printing of the contain of the REPORTS and the transfer of extracts to other applications, provided that the beneficiary fulfills the following requirements:
     
   1. The beneficiary is allowed to reproduce directly from the REPORTS, for his/her internal use, a part or the totality of the contents which is subject to intelectual property. This permission will have effect provided that such copies are destroyed within the next 30 days from the copy date, with the exception of the condition stipulated in clause 5.2), which is stated bellow. The beneficiary is not allowed to file the copies in order to complete a compilation of reference in printed paper.
        
   2. No part of the REPORTS can be transferred to other application, but they can be included in documents of internal use of the beneficiary, provided that the part added does not exceed the 10% of each REPORT. KONDIA will keep on owning the copyright of such parts of which the ownership will be perfectly identified.
        
   3. Under no circumstances will the beneficiary be allowed to reproduce a part of the totality of any REPORT for no other user than the cases stipulated in above clauses 5.1) y 5.2).
        
   4. Under no circumstances will the beneficiary be allowed to lend, rent, sale or distribute copies extracted from the REPORTS.
        
6. Confidencialidad. El conocimiento de cualquier información contenida en los documentos tiene la consideración de confidencial y secreto comercial. El beneficiario se obliga a respetar y actuar de acuerdo con este pacto de confidencialidad. Se excluye de este acuerdo la información que sea de dominio público..
     
7. KONDIA does not specifically or implicitly assure that the REPORTS are suitable for any specific target, or they are effective to carry out any specific function.
     
   The beneficiary will send a notification to Kondia in writing within the 30 natural days from the reception of REPORTS, if he/she detects any defect or error. In case the beneficiary does not notify anything to KONDIA at this respect, it will be understood that the REPORTS are given his/her approval.
     
8. KONDIA will not be responsible to the beneficiary for any possible direct or indirect damage related to this License, even if the damage in question originates loss of profit, income, use (or similar financial loss), any payment effected or due to third parties, economical loss or any limitation of the REPORTS to effect any specific function.
     
   Any type of responsability of KONDIA to the beneficiary and related to the supply of the REPORTS will not exceed the amount specified as for their License rights.
   The beneficiary will allow any authorized representative of KONDIA to visit his/her premises in order to check if the terms of this License are being duly fulfilled.
     
9. KONDIA does not assume any responsability to the beneficiary for any possible misunderstanding or distorsion originated by any possible oral communication between the parties whatever its origin is.
     
   Any formal information which any of the partys can give or is obliged to give to the other party will be sent by registered mail and the receipt of the post office will be a proof that it has been duly received.
     
10. Both contracting parties will specifically refuse their corresponding jurisdiction for any event related to the interpretation or performance of this contract and they agree to submit to the jurisdiction and competence of the Courts of Madrid.

YOU STATE THAT YOU HAVE READ THE TERMS OF THIS LICENSE OF USE AND COMMIT YOURSELF TO RESPECT THEM
